Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs your use of the Jako website, platform, applications, and related services (collectively, the “Service”).
This AUP forms part of and should be read together with Jako’s Terms of Service and Privacy Policy.
Jako provides software tools that help users organize contacts, manage outreach, create and send email campaigns, track engagement, manage follow-ups, and organize related business activities. Users are responsible for how they use these tools, the contacts and information they provide to Jako, and the communications they choose to send.
By accessing or using the Service, you agree to comply with this AUP.
1. General Requirement
You may use Jako only for lawful, legitimate, and authorized purposes.
You are responsible for your conduct, your account, your contacts and data, and all communications or activities performed through your account.
You may not use Jako in any manner that violates applicable law, infringes the rights of another person, interferes with the Service, harms Jako or its service providers, or exposes Jako, its users, or third parties to unreasonable legal, security, operational, or reputational risk.
2. Email and Outreach Responsibilities
Jako provides tools that allow users to organize and send email outreach. Jako does not independently select your recipients, determine whom you should contact, create your recipient lists, or determine whether a particular communication is legally permissible.
You are responsible for ensuring that your outreach complies with all laws, regulations, industry requirements, contractual obligations, and platform rules applicable to you and your recipients.
Depending on your activities and the jurisdictions involved, these may include laws and requirements relating to:
- Commercial email;
- Electronic communications;
- Advertising and marketing;
- Privacy and data protection;
- Consent;
- Unsubscribe and opt-out rights;
- Consumer protection; and
- Collection and use of personal information.
You must maintain any consent, permission, lawful basis, or other authorization required for your communications.
3. Spam and Unwanted Communications
You may not use Jako to send spam or communications that are prohibited by applicable law.
You may not:
- Send communications to recipients where you are legally prohibited from doing so;
- Continue sending communications to a recipient after the recipient has validly opted out where applicable law requires you to honor that request;
- Intentionally disregard unsubscribe or opt-out requests;
- Use recipient lists that you know were obtained unlawfully;
- Send deceptive mass communications designed to evade spam protections;
- Use Jako primarily to generate abusive complaint rates, bounce rates, or other harmful sending behavior; or
- Engage in conduct intended to damage the reputation of Jako, Gmail, email providers, sending domains, IP addresses, or other infrastructure.
Jako may investigate, restrict, suspend, or terminate activity that appears abusive or presents an unreasonable risk to the Service, Jako, its users, its service providers, or third-party infrastructure.
4. Unsubscribe and Opt-Out Requirements
You are responsible for providing and honoring unsubscribe or opt-out mechanisms where required by applicable law.
You may not intentionally:
- Remove legally required unsubscribe functionality;
- Misrepresent an unsubscribe mechanism;
- Continue sending prohibited communications after a valid opt-out;
- Manipulate Jako functionality to bypass suppression or unsubscribe records; or
- Re-add recipients for the purpose of circumventing a previous opt-out.
Where Jako provides unsubscribe, suppression, or related functionality, you must not intentionally interfere with or circumvent that functionality.
5. Prohibited Fraudulent or Deceptive Activity
You may not use Jako to engage in fraud, deception, impersonation, or other dishonest conduct.
Prohibited activities include:
- Phishing;
- Credential theft;
- Identity theft;
- Financial fraud;
- Investment scams;
- Advance-fee scams;
- Business email compromise;
- Fake invoices;
- Fraudulent payment requests;
- Deceptive solicitations;
- Misrepresentation of your identity or affiliation;
- Impersonation of another individual or organization without authorization; or
- Communications intended to trick recipients into providing passwords, authentication codes, financial information, or other sensitive information.
6. Malware and Harmful Technology
You may not use Jako to distribute, promote, facilitate, or direct recipients to:
- Malware;
- Viruses;
- Ransomware;
- Spyware;
- Malicious scripts;
- Credential-stealing software;
- Harmful downloads;
- Exploit kits;
- Malicious websites; or
- Other technology designed to compromise, damage, disrupt, monitor, or gain unauthorized access to systems, accounts, devices, or data.
You may not use Jako to test, probe, attack, or exploit systems without authorization.
7. Harassment, Threats, and Abuse
You may not use Jako to send communications that unlawfully harass, threaten, stalk, intimidate, exploit, or abuse another person.
You may not use the Service to facilitate:
- Credible threats of violence;
- Unlawful harassment;
- Stalking;
- Extortion;
- Blackmail;
- Doxxing;
- Non-consensual disclosure of highly sensitive personal information; or
- Coordinated abuse directed at an individual or organization.
8. Illegal Activities
You may not use Jako to promote, facilitate, organize, or conduct activities that are illegal under applicable law.
This includes using Jako to knowingly facilitate illegal transactions, fraud, trafficking, exploitation, theft, or other unlawful conduct.
Jako is not responsible for independently determining the legality of every user’s business, contact list, recipient, campaign, or communication. Users remain responsible for ensuring their activities comply with applicable law.
9. Personal Information and Contact Data
You may only upload, import, enter, store, or process personal information through Jako when you have the legal right or lawful basis to do so.
You may not knowingly use Jako to:
- Store personal information obtained through unlawful means;
- Process stolen databases or contact lists;
- Use personal information in violation of applicable privacy or data protection law;
- Circumvent legally required consent or privacy rights;
- Unlawfully disclose another person's personal information; or
- Collect or process information through deceptive or fraudulent means.
You are responsible for the legality, accuracy, source, and permitted use of information you provide to Jako.
10. Purchased, Scraped, or Third-Party Contact Lists
Jako does not independently verify the source of every contact uploaded by a user.
If you use purchased, licensed, scraped, publicly available, or third-party contact information, you are solely responsible for determining whether your acquisition, possession, processing, and use of that information is lawful and permitted.
The fact that information is publicly accessible does not necessarily mean that every collection, processing, or use of that information is legally permitted.
You may not use Jako with contact information that you know was obtained unlawfully, through unauthorized access, or in violation of applicable legal restrictions.
11. Gmail and Third-Party Services
If you connect Gmail or another third-party service to Jako, you must comply with the terms, policies, restrictions, and usage limits imposed by that provider.
You may not use Jako to intentionally:
- Circumvent Gmail or another provider's sending limits;
- Evade spam or abuse protections;
- Circumvent account restrictions;
- Bypass rate limits;
- Manipulate reputation systems;
- Avoid enforcement actions;
- Create or operate accounts for the purpose of evading provider restrictions; or
- Cause Jako to violate the terms or policies of a connected third-party service.
Jako does not guarantee that a third-party provider will permit any particular volume, recipient, content, or type of communication.
Third-party providers may independently block, restrict, delay, reject, classify, suspend, terminate, or otherwise act upon communications or accounts.
12. Unauthorized Access and Security Abuse
You may not attempt to gain unauthorized access to Jako, another user’s account, another workspace, Jako infrastructure, or any system connected to the Service.
You may not:
- Attempt to bypass authentication or authorization controls;
- Access another user's data without authorization;
- Probe the Service for vulnerabilities without written authorization;
- Exploit vulnerabilities;
- Interfere with security mechanisms;
- Use stolen credentials;
- Share access credentials in a manner that creates unauthorized access;
- Attempt to extract secrets, tokens, credentials, or private system information; or
- Circumvent technical restrictions imposed by Jako.
If you discover a potential security vulnerability, you should report it to support@jakocrm.com rather than exploiting it.
13. Interference With the Service
You may not use Jako in a manner that intentionally or recklessly interferes with the normal operation, performance, availability, or security of the Service.
This includes:
- Excessive automated requests;
- Denial-of-service activity;
- Attempts to overload infrastructure;
- Deliberate creation of unreasonable resource consumption;
- Circumvention of technical limits;
- Automated activity designed to degrade performance; or
- Interference with another user's ability to use Jako.
14. Automation and Circumvention
You may use automation features provided by Jako for their intended purposes.
You may not use external automation, scripts, bots, or other mechanisms to circumvent limitations, access controls, billing restrictions, rate limits, subscription requirements, security controls, or other safeguards imposed by Jako.
You may not reverse engineer or manipulate Jako for the purpose of obtaining unauthorized access to paid functionality or restricted resources, except to the extent such restriction is prohibited by applicable law.
15. Account and Identity Misrepresentation
You must provide materially accurate account information where required.
You may not create or use an account:
- Under another person's identity without authorization;
- To impersonate another business or organization;
- Using information obtained through identity theft;
- To evade a previous suspension or termination;
- To conceal fraudulent activity; or
- For another unlawful or deceptive purpose.
16. Intellectual Property and Third-Party Rights
You may not use Jako to knowingly infringe or misappropriate the intellectual property, privacy, publicity, contractual, or proprietary rights of others.
You are responsible for ensuring that content, trademarks, images, attachments, templates, text, contact information, and other materials you upload, send, or distribute through Jako may lawfully be used by you for the intended purpose.
17. Sensitive and Regulated Information
Jako is a general-purpose CRM and outreach platform and is not designed to serve as a specialized repository for highly sensitive or regulated information unless Jako expressly states otherwise.
You should not use Jako to store information requiring specialized security, regulatory, or contractual safeguards that Jako has not expressly agreed in writing to provide.
You are responsible for determining whether Jako is appropriate for the information you choose to process and whether additional legal, contractual, technical, or security requirements apply to you.
18. Resale and Unauthorized Commercial Exploitation
You may not resell, sublicense, rent, lease, reproduce, white-label, or commercially exploit access to Jako except where expressly authorized by Jako in writing.
You may not use Jako infrastructure to operate a competing service through unauthorized access to Jako functionality, APIs, systems, or resources.
19. Jako Does Not Provide Legal or Compliance Advice
Jako provides software tools. Jako does not provide legal advice, regulatory advice, compliance advice, or a determination that any particular activity is lawful.
Nothing provided through the Service should be interpreted as a representation or guarantee that:
- A particular contact may legally be contacted;
- A contact list was lawfully obtained;
- A recipient has provided legally sufficient consent;
- A particular communication complies with applicable law;
- A campaign satisfies applicable marketing or privacy requirements;
- A particular unsubscribe mechanism satisfies every applicable legal requirement; or
- A user's activities comply with the policies of Gmail or another third-party provider.
You are responsible for obtaining your own legal or professional advice where appropriate.
20. Availability of a Feature Does Not Constitute Approval
The fact that Jako allows, enables, processes, transmits, stores, organizes, tracks, or otherwise technically permits an action does not mean that Jako has reviewed, approved, authorized, endorsed, verified, or represented that the action is lawful, appropriate, compliant, or permitted by a third party.
Jako’s technical ability to process a contact, campaign, communication, recipient, template, attachment, workflow, or other activity does not relieve you of responsibility for that activity.
The absence of an automated warning, restriction, block, or enforcement action does not constitute approval of your conduct.
21. User Responsibility for Compliance
You are responsible for identifying and complying with the laws, regulations, contractual requirements, industry rules, and third-party policies applicable to your use of Jako.
You are responsible for obtaining and maintaining any consent, permission, authorization, notice, lawful basis, license, or other legal authority required for:
- Collecting contact information;
- Uploading or importing information into Jako;
- Storing or processing information;
- Contacting recipients;
- Sending marketing or commercial communications;
- Tracking engagement;
- Recording and managing reply status and related engagement information; and
- Conducting your campaigns and other activities.
Jako does not assume responsibility for making these determinations on your behalf.
22. User Responsibility for Third-Party Consequences
Your use of Jako may affect your relationship with recipients, email providers, domain providers, regulators, customers, prospects, or other third parties.
To the extent permitted by applicable law and subject to Jako’s Terms of Service, Jako is not responsible for consequences resulting from your conduct, content, recipients, contact lists, sending practices, or violations of applicable requirements, including:
- Spam complaints;
- Recipient complaints;
- Unsubscribe disputes;
- Delivery failures;
- Email filtering;
- Domain or sender reputation changes;
- Account limitations or suspensions imposed by third parties;
- Gmail or other provider enforcement;
- Regulatory inquiries or investigations; or
- Other actions taken by third parties in response to your activities.
Nothing in this section excludes responsibility that cannot lawfully be excluded.
23. Indemnification and Claims Arising From Your Conduct
Your use of Jako remains subject to the indemnification provisions contained in Jako’s Terms of Service.
To the extent provided by those Terms, your indemnification obligations may apply where claims, demands, proceedings, liabilities, damages, losses, costs, or expenses arise from or relate to matters including:
- Your use or misuse of the Service;
- Your communications or campaigns;
- Your recipients or contact lists;
- Information or content you provide;
- Your violation of this AUP or the Terms of Service;
- Your violation of applicable law;
- Your violation of another person's rights; or
- Your violation of third-party service terms or policies.
This AUP does not replace or limit any broader indemnification obligation contained in the Terms of Service.
24. Monitoring and Enforcement
Jako may take reasonable measures to protect the Service, users, service providers, infrastructure, and third parties from abuse.
Where permitted by applicable law and consistent with our Privacy Policy, we may investigate suspected violations of this AUP based on information available to us, including complaints, technical signals, account activity, security information, or information provided by third parties.
Jako is not obligated to proactively monitor every communication, contact, campaign, user activity, or piece of content or to independently determine the legality of every user’s activities.
Failure by Jako to detect, prevent, restrict, or take action against a particular activity does not constitute approval of that activity or a waiver of Jako’s rights.
25. Cooperation With Legal and Abuse Investigations
Subject to applicable law and Jako’s Privacy Policy, Jako may preserve, review, or disclose information when reasonably necessary to:
- Respond to valid legal process;
- Comply with applicable law, court orders, subpoenas, or governmental requests;
- Investigate suspected fraud, abuse, security incidents, or violations of this AUP;
- Protect the rights, property, safety, security, or integrity of Jako, its users, service providers, or others;
- Respond to legitimate abuse complaints; or
- Establish, exercise, or defend legal claims.
Nothing in this section creates an obligation for Jako to investigate or resolve private disputes between users and third parties.
26. Suspension and Restriction
If we reasonably believe that your use of Jako violates this AUP, our Terms of Service, applicable law, third-party provider requirements, or presents a material security, legal, operational, financial, or reputational risk, we may take action reasonably appropriate to protect Jako and others.
Such actions may include:
- Warning you;
- Requesting additional information;
- Restricting particular functionality;
- Limiting sending or other activity;
- Temporarily suspending access;
- Disabling integrations;
- Removing or restricting content where appropriate; or
- Terminating access to the Service.
Where appropriate and reasonably practicable, we may provide notice or an opportunity to correct a violation. However, immediate action may be taken where reasonably necessary to address serious abuse, security threats, fraud, unlawful activity, provider requirements, or risk to Jako or third parties.
Nothing in this section requires Jako to continue providing access while investigating suspected misconduct.
27. No Obligation to Deliver Communications
Use of Jako does not guarantee that an email or other communication will be sent, received, delivered, opened, read, displayed correctly, or accepted by a recipient or third-party provider.
Email providers and other third parties may independently block, delay, filter, reject, classify, modify, quarantine, or otherwise restrict communications.
Users remain responsible for their sending practices and sender reputation.
28. Reporting Abuse
If you believe Jako is being used in violation of this AUP, you may report the issue to:

29. Changes to This Acceptable Use Policy
We may update this AUP from time to time to reflect changes to the Service, applicable law, security practices, third-party provider requirements, or abuse-prevention practices.
When appropriate, we may provide notice of material changes through the Service, by email, or through another reasonable method.
The “Last Updated” date at the top indicates when this AUP was most recently revised.
30. Relationship to the Terms of Service
This AUP is incorporated into and forms part of Jako’s Terms of Service.
If your use of Jako violates this AUP, it may also constitute a violation of the Terms of Service.
If there is a conflict between this AUP and the Terms of Service, the Terms of Service will control unless expressly stated otherwise.
The remedies and protections available to Jako under this AUP are in addition to those available under the Terms of Service and applicable law.
